One of the complaints that I hear from employers is, “I tried to bring the employee back to work but they complained the whole time they were here. Finally, in frustration, we let the employee go home and they never returned to work.” The employee’s plan of manipulation worked.

The reason why employees are able to manipulate the workers’ compensation system and refuse to accept modified-duty positions is because the employer does not follow the process through to a logical conclusion. In particular, approval of the modified- or light-duty job is not routinely obtained from the treating physician.
